The West Wing a question

I noticed a cable channel is airing a bunch of s7 episodes of the West Wing today. I quit watching the show around s5 so I don't know all that's going on, but I was reading about the very last episode of the show and I have a question I'll put under a cut in case there's anyone on my flist who has started the show late and isn't up to s7 yet. What did Toby do that would require a presidential pardon?

I've finished season 6 on Sunday morning. I'm up to ep 13 in s7 now.
